Multi-party claim in Technology and Construction Court relating to landmark residential development
The Case
We are currently engaged in a multi-party dispute in the Technology and Construction Court arising from the structural failure of a 500-metres long, 4-metres high earth retaining crib lock wall at a prestigious housing development in central England.
We act for the claimant, an award-winning national housebuilding company. The claimant has advanced claims against three parties including the company that designed the criblock structure and the structural engineers for the development.
The wood and earth structure was designed and built as a unique ecological feature at a landmark “eco-friendly” housing development and urban renewal project. The structure has substantially failed within 10 years of its construction and is no longer considered safe. The claimant has no option but to demolish the structure and replace it at a cost of several million pounds and seeks damages and an indemnity from the parties allegedly involved in its design and construction.
The Challenges
The claimant is advancing three different claims against three separate defendants in this case.
A range of expert evidence is required including from structural engineers, quantity surveyors, landscape architects and a wood preservation expert. Further input has also been obtained from specialist environmental consultants.
How We Helped
We have a flexible and experienced team who are all well versed in construction litigation. This allows us to adapt to the ebbs and flows of litigation especially in large, complex cases involving multiple parties. This is more important still when representing a claimant as the onus is on us to drive the case forward without delay.
In practical terms, all of this means that we have the ability to collaborate and pool our collective experience and expertise during critical points of the case. For example, we recently undertook a substantial e-disclosure exercise involving the processing of millions of documents over a period of just a few weeks. Equally, when it comes to key moments such as preparing witness statements or getting a case ready for Trial we have a flexible and experienced team which enables us to focus our attention and resource when it is needed the most.
